DJ AUTO BODY REPAIR
Mobile Vehicle Body Repair Terms & Conditions
Dean Seville t/a DJ Auto Body Repair
Version: August 2026
These Terms & Conditions apply to vehicle body repair services supplied by Dean Seville, a sole trader trading as DJ Auto Body Repair ("DJ Auto Body Repair", "we", "us" or "our").
They explain the basis upon which we provide quotations, accept bookings and carry out repairs, together with the responsibilities of DJ Auto Body Repair and the Customer.
Our repairs are primarily mobile, although Repairs may also be carried out at 21 Shorcroft Avenue, Denton, Manchester, M34 2BE, where agreed.
By accepting a Quotation, confirming a Booking, electronically accepting these Terms & Conditions or otherwise instructing us to proceed with work, the Customer agrees to these Terms & Conditions.
Nothing in these Terms & Conditions excludes, restricts or replaces any statutory rights available to a Consumer under applicable UK law.
1. DEFINITIONS
Customer means the individual, company or organisation requesting or authorising the Repair.
Consumer means an individual acting wholly or mainly outside their trade, business, craft or profession.
Business Customer means a person, company, partnership, organisation or other entity entering into the contract wholly or mainly for purposes relating to their trade, business, craft or profession.
Vehicle means the vehicle identified within the Quotation or Booking.
Quotation means our written or electronic offer to undertake specified work for the stated price.
Repair means the bodywork and/or paint refinishing work specifically identified within the accepted Quotation.
SMART Repair means a Small to Medium Area Repair Technique or other appropriate localised vehicle body repair method.
Booking means the confirmed appointment date, approximate time or appointment window and agreed location for the Repair.
Booking Fee means any payment requested by DJ Auto Body Repair to secure and confirm an appointment.
Customer Photographs means photographs or videos supplied by the Customer for assessment or quotation purposes.
Warranty means the additional 3-Year Bodywork Workmanship Warranty described within these Terms.
2. QUOTATIONS
Quotations may be prepared using photographs, videos, descriptions and other information supplied by the Customer.
A Quotation prepared before physical inspection is based upon the information reasonably available to us at the time.
Customer Photographs should clearly show the complete damaged area, surrounding panels and sufficient context to allow us to reasonably assess the nature and approximate extent of the damage.
Some damage, previous repairs and underlying conditions cannot reasonably be identified from photographs alone.
The Quotation therefore assumes that the actual condition of the Vehicle materially corresponds with the information supplied.
If inspection or preparation reveals circumstances materially different from those represented during the original enquiry, we may:
- Amend the proposed Repair method;
- Provide a revised Quotation;
- Recommend alternative work;
- Postpone the Repair; or
- Decline to proceed where the Repair is unsuitable.
Where a change would increase the agreed price, we will obtain the Customer's authorisation before undertaking additional chargeable work, where reasonably practicable.
The Customer is under no obligation to accept a revised Quotation.
Unless stated otherwise, Quotations are valid for 30 days from the date of issue.
3. CUSTOMER-SUPPLIED INFORMATION & PHOTOGRAPHS
The Customer is responsible for providing information which is accurate to the best of their knowledge.
Customers should disclose any known:
- Previous body repairs;
- Previous paintwork or resprays;
- Body filler;
- Accident repairs;
- Non-original finishes;
- Vinyl wraps;
- Paint protection film;
- Ceramic coatings;
- Specialist paint finishes;
- Corrosion or rust;
- Cracked substrates; or
- Other conditions which may affect the Repair.
Photographs cannot always reveal:
- The depth or full extent of damage;
- Hidden damage;
- Previous body filler;
- Substrate condition;
- Adhesion problems;
- Previous poor-quality Repairs;
- Concealed corrosion; or
- Other underlying defects.
Customer Photographs may be retained as part of our quotation and repair records in accordance with our Privacy Policy.
4. CORROSION & RUST
DJ Auto Body Repair does not undertake corrosion or rust repairs.
We do not quote for, treat, remove, repair or warrant corrosion or rust.
Where corrosion is visible or known before an appointment, we may decline the Repair.
Where previously unidentified corrosion is discovered during inspection or preparation, we may stop the Repair where continuing would be unsuitable or could compromise Repair quality, durability or safety.
Corrosion may be concealed underneath paint, primer, body filler, previous Repairs, seams or panel edges and may therefore not reasonably be identifiable before preparation begins.
The Warranty does not cover failure caused by:
- Pre-existing corrosion;
- Concealed corrosion;
- Corrosion underneath previous filler or Repairs;
- Corrosion originating behind or inside a panel;
- Corrosion around seams or panel edges;
- Corrosion spreading from adjoining areas; or
- Paint or material failure caused by underlying corrosion.
This exclusion applies where corrosion caused the failure. It does not exclude responsibility for defects caused by our workmanship.
5. REPAIR SUITABILITY
Not every type of vehicle damage is suitable for SMART or mobile Repair.
We reserve the right to determine whether the proposed Repair can reasonably and safely be completed using the intended method.
Following physical inspection, we may recommend:
- A different Repair technique;
- Repair at another suitable location;
- Component replacement;
- Specialist Repair; or
- That the Repair is not undertaken by us.
We will not knowingly undertake a method we reasonably believe would prevent us from achieving an appropriate professional Repair.
6. MOBILE REPAIR LOCATIONS
For mobile Repairs, the Customer must provide a safe, lawful and reasonably suitable location.
Where reasonably required, there must be:
- Sufficient working space around the Vehicle;
- Safe access for our mobile Repair vehicle and equipment;
- Reasonably level and stable ground;
- Suitable clearance from traffic and pedestrians;
- Lawful permission for work to take place; and
- Reasonable access to the Vehicle.
We may refuse, postpone or discontinue work where the location is reasonably considered unsafe, unlawful or unsuitable.
7. REPAIRS AT 21 SHORCROFT AVENUE
Some Repairs may, by agreement, be carried out at:
21 Shorcroft Avenue
Denton
Manchester
M34 2BE
Where a Vehicle is left at this location, the Customer authorises DJ Auto Body Repair to keep the Vehicle for the reasonable period necessary to carry out the agreed Repair.
The Customer should remove valuables, cash, fragile objects and irreplaceable belongings before leaving the Vehicle.
The Customer must inform us of any known Vehicle security issue, immobiliser problem, locking fault or other issue relevant to the safe movement or storage of the Vehicle.
DJ Auto Body Repair will exercise reasonable care while the Vehicle is in our possession.
The fact that a Vehicle is left at the premises does not exclude our legal responsibility for loss or damage caused by our negligence, breach of contract or failure to exercise reasonable care.
8. AUTHORITY TO MOVE & PARK THE VEHICLE
The Customer authorises DJ Auto Body Repair and authorised personnel to reasonably:
- Start the Vehicle;
- Move the Vehicle;
- Reposition the Vehicle;
- Move it on or off the driveway;
- Move it around the Repair location;
- Temporarily move it onto an adjoining or nearby public road; and
- Park it in another lawful nearby location,
where reasonably necessary for the Repair, access, drying, inspection, collection or management of available space.
Movement will be limited to what is reasonably necessary.
The Customer confirms, to the best of their knowledge, that where the Vehicle may need to be driven or parked on a public road, it is legally capable of doing so and that relevant information concerning insurance, roadworthiness or restrictions has not knowingly been withheld.
DJ Auto Body Repair will take reasonable care when moving and parking the Vehicle.
We will not be responsible for a penalty or loss caused solely by a Vehicle itself not being legally entitled to use or remain on a public road where the relevant issue was not disclosed to us.
This does not exclude responsibility where a penalty or loss arises because of our own failure to use or park the Vehicle lawfully.
9. VEHICLES LEFT AT THE PREMISES
Vehicles are left with DJ Auto Body Repair with the owner's or authorised Customer's consent for the purposes of completing the agreed Repair.
We are not responsible for loss, deterioration or damage which was not caused by DJ Auto Body Repair, including:
- Pre-existing damage;
- Unrelated mechanical or electrical failure;
- Deterioration caused by a pre-existing Vehicle defect;
- Loss of unsecured personal possessions;
- Acts of third parties outside our reasonable control;
- Vandalism not caused or facilitated by our failure to exercise reasonable care;
- Severe weather or environmental events outside our reasonable control; or
- Another event which is not attributable to a breach of our obligations.
Nothing within these Terms amounts to an absolute "owner's risk" exclusion.
DJ Auto Body Repair remains responsible for exercising reasonable care while the Vehicle is in our possession.
10. WEATHER & ENVIRONMENTAL CONDITIONS
Mobile refinishing depends upon suitable environmental conditions.
We may postpone, relocate or rearrange a Repair because of:
- Rain;
- Excessive moisture;
- High winds;
- Extreme temperatures;
- Dust;
- Airborne contamination; or
- Other conditions which could adversely affect safety or Repair quality.
Weather conditions can change unexpectedly and may occasionally require same-day postponement.
Where we postpone solely because environmental conditions are unsuitable and the Customer is not responsible, no missed appointment charge will normally apply.
11. APPOINTMENT TIMES
Appointment and arrival times are estimates unless expressly agreed otherwise.
Mobile technicians travel between locations and Repair duration can vary.
Traffic, previous jobs, weather, road closures, equipment problems and circumstances outside our reasonable control may affect arrival times.
Where reasonably possible, we will notify the Customer of a significant anticipated delay.
12. BOOKING FEES
DJ Auto Body Repair may require a Booking Fee before an appointment is confirmed.
Where required, the Customer will be informed of:
- The amount;
- When payment is required;
- Whether it forms part of the Repair price; and
- Applicable cancellation conditions.
Where the Booking Fee forms part of the Repair price, it will be deducted from the final balance.
Where we have stated that a Booking Fee is required, the Booking is not confirmed until that fee has been received.
Any amount retained following cancellation will be limited to an amount which may reasonably and lawfully be retained having regard to the circumstances and losses incurred.
We will take reasonable steps to reduce our losses, including attempting to reallocate cancelled diary capacity where reasonably practicable.
A Booking Fee is not automatically forfeited merely because a Booking is cancelled.
Where DJ Auto Body Repair cancels and no service has been supplied, any Booking Fee will normally be refunded or, with the Customer's agreement, transferred to another appointment.
Nothing within this section affects statutory cancellation rights.
13. CUSTOMER RESPONSIBILITIES
The Customer must ensure that:
- The correct Vehicle is present;
- The Vehicle is accessible;
- Required keys are available;
- Sufficient working space is available;
- Necessary permission to work at the location has been obtained; and
- Requirements communicated before the appointment have reasonably been complied with.
14. APPOINTMENT REMINDERS
We will normally send an appointment reminder approximately 24 hours before the Booking.
The reminder is provided as a courtesy.
Failure to receive, notice or read the reminder does not automatically cancel the Booking or remove the Customer's responsibility to make the Vehicle available.
15. MISSED APPOINTMENTS & FAILED CALL-OUTS
Where we attend a confirmed appointment but cannot reasonably commence the Repair because of circumstances within the Customer's control, a Missed Appointment / Call-Out Charge of up to £100 may apply.
Examples include:
- The Customer forgetting the appointment;
- The Vehicle not being present;
- Nobody being available to provide necessary access;
- Required keys being unavailable;
- The Vehicle being inaccessible;
- An incorrect address being supplied;
- The Vehicle being moved without notifying us; or
- Suitable working space not being available despite requirements having previously been communicated.
This charge is not intended as a penalty.
Any amount charged will be reasonable and proportionate to losses arising from the failed appointment, including technician time, travel, fuel and lost diary capacity.
The charge will not exceed £100.
No charge will apply where the inability to undertake the Repair is attributable to DJ Auto Body Repair or where imposing the charge would otherwise be unreasonable or unlawful.
16. CANCELLATIONS & REBOOKING
Customers should provide as much notice as reasonably possible when cancelling or rearranging.
Following a cancellation, rearrangement or missed appointment, we may require a Booking Fee or deposit before confirming another appointment.
If a replacement Booking is subsequently cancelled or rearranged, we may retain an amount only to the extent reasonably necessary to reflect losses arising directly from that cancellation.
We may require advance payment or a Booking Fee from Customers who have repeatedly cancelled, rearranged or failed to attend appointments.
Nothing within this section affects statutory cancellation rights.
17. HOW TO CANCEL OR REARRANGE
Cancellation or rearrangement may be communicated in writing using:
- SMS/text;
- WhatsApp; or
- Email.
The Customer should provide sufficient information for us to identify the Booking.
Where statutory cancellation rights apply, a clear statement communicating the Customer's decision to cancel will be accepted.
18. METHOD OF BOOKING & CONTRACT FORMATION
Bookings may be entered into through:
- Our website;
- Online quotation or Booking systems;
- SMS;
- WhatsApp;
- Email;
- Telephone; or
- Face-to-face communication.
A contract entered into entirely remotely may constitute a distance contract.
A contract entered into face-to-face away from our business premises may constitute an off-premises contract.
A contract entered into face-to-face at our business premises will not normally attract statutory cooling-off rights applying specifically to distance and off-premises contracts.
Other statutory rights remain unaffected.
19. STATUTORY CANCELLATION PERIOD
Where applicable consumer legislation provides a statutory cancellation period for a distance or off-premises service contract, the Customer will receive the cancellation rights required by law.
For applicable service contracts, this will generally be 14 days.
Where legally required, appropriate cancellation information and the statutory model cancellation form will be supplied separately.
The Customer does not have to use that form and may communicate their cancellation by another clear statement.
20. REPAIRS WITHIN THE 14-DAY CANCELLATION PERIOD
DJ Auto Body Repair frequently undertakes Repairs within 14 days of the contract being entered into, including same-day and short-notice appointments.
Where an applicable distance or off-premises contract is to begin during the statutory cancellation period, we will obtain the Customer's express request for the service to begin during that period where required by law.
Where required, the Customer will also acknowledge that once the agreed service has been fully performed, their statutory right to cancel that completed service will be lost.
If the Customer validly cancels after expressly requesting an early start but before the agreed service has been fully completed, the Customer may be required to pay a proportionate amount for the service already properly supplied where permitted by law.
These provisions concern the Customer's right to change their mind.
They do not remove rights relating to defective or unsatisfactory workmanship.
21. PREVIOUS REPAIRS & HIDDEN DAMAGE
We cannot guarantee the integrity of paint, filler, primer or other materials previously applied by another Repairer.
Preparation may reveal:
- Excessive or cracked filler;
- Poor previous preparation;
- Failing primer;
- Hidden accident damage;
- Poor adhesion;
- Contamination;
- Corrosion; or
- Incompatible coatings.
We are not responsible for failure of underlying previous work unless our workmanship caused or materially contributed to the failure.
Where additional chargeable work becomes necessary, Customer authorisation will normally be obtained before proceeding.
22. PAINT COLOUR MATCHING
We use professional automotive paint systems and colour-matching techniques.
Vehicle colour may vary because of:
- Age;
- UV exposure;
- Previous refinishing;
- Manufacturing variation;
- Paint fade; and
- Environmental exposure.
Certain colours may require blending into adjoining areas.
We will exercise reasonable care and skill when colour matching.
23. NATURE & BOUNDARIES OF THE REPAIR
A hand-completed aftermarket body Repair does not use precisely the same manufacturing process as the Vehicle's original factory finish.
SMART and localised Repairs are intended to restore suitable damage to an appropriate professional aftermarket standard.
A trained professional or inspector may sometimes identify that a Vehicle has previously undergone refinishing.
Our Quotation covers only the damage and areas specifically identified.
Unless expressly included, the following unrelated items are outside the agreed Repair:
- Stone chips;
- Scratches;
- Dents;
- Corrosion;
- Paint defects;
- Previous Repairs;
- Trim defects; or
- Other imperfections.
Nothing within this section reduces our obligation to perform the Repair with reasonable care and skill.
24. ADAS, SENSORS, CAMERAS & ELECTRONICS
Unless expressly included within the Quotation, our cosmetic bodywork service does not include:
- ADAS calibration;
- Radar calibration;
- Camera calibration;
- Parking sensor diagnosis;
- Electronic diagnosis;
- Programming;
- Coding;
- Manufacturer software procedures; or
- Unrelated electrical Repairs.
Where specialist calibration or diagnostic work may be appropriate, we will advise the Customer where reasonably practicable.
25. MECHANICAL & ELECTRICAL SYSTEMS
DJ Auto Body Repair provides cosmetic vehicle bodywork and paint Repair services.
Unless expressly included within the accepted Quotation, we do not diagnose, Repair or warrant mechanical, drivetrain, electrical or electronic Vehicle systems.
We are not responsible for pre-existing or unrelated mechanical or electrical faults which become apparent before, during or after the Repair.
This may include faults involving:
- Engines;
- Transmissions;
- Suspension;
- Steering;
- Braking systems;
- 12-volt batteries;
- Warning lights;
- Sensors;
- Wiring;
- Control modules;
- Charging systems;
- High-voltage systems; or
- Other mechanical or electrical components.
The fact that a mechanical or electrical problem becomes apparent during or after a cosmetic body Repair does not by itself establish that the problem resulted from our work.
Where a Customer alleges that a fault resulted from our Repair, we should be given a reasonable opportunity to inspect the Vehicle and investigate the alleged cause.
Nothing within this section excludes responsibility for mechanical, electrical or electronic damage directly caused by our negligence, breach of contract or failure to exercise reasonable care and skill.
26. ELECTRIC & HYBRID VEHICLES
Electric and hybrid Vehicles contain high-voltage batteries, cabling, power electronics and specialist systems.
DJ Auto Body Repair does not undertake high-voltage battery Repair, high-voltage electrical diagnosis or specialist EV/hybrid electrical work unless expressly agreed and within the competence and scope of the technician carrying out the work.
Where suitable, dents on electric or hybrid Vehicles may be repaired using glue-pull or another suitable non-invasive technique.
This may enable suitable damage to be repaired without unnecessary removal of components, powering down of the Vehicle or disturbance of high-voltage systems.
Where glue pulling is selected specifically to avoid intrusive work around an EV or hybrid system, we will not unnecessarily disconnect, isolate or interfere with the Vehicle's high-voltage system.
The method selected will depend upon:
- Damage location;
- Panel construction;
- Damage severity;
- Paint condition;
- Accessibility;
- Manufacturer requirements; and
- Whether an appropriate Repair can reasonably be achieved.
Where safe or satisfactory completion would require specialist high-voltage isolation, removal of high-voltage components or specialist procedures outside our competence or service scope, we may decline or stop the Repair and recommend referral to an appropriately qualified specialist.
Nothing within these Terms permits us to disregard applicable safety or manufacturer requirements.
27. TRIM, MOULDINGS, CLIPS & COMPONENTS
Unless expressly included, replacement badges, trim, mouldings, clips, brackets, fixings, sensors, grilles, lamps or other components are not included within the Quotation.
Older, brittle or previously damaged components may sometimes fail during reasonable removal.
Where replacement becomes necessary, additional costs will be discussed before ordering or fitting replacement parts, where reasonably practicable.
28. CUSTOMER AUTHORITY
The person accepting the Quotation confirms that they either own the Vehicle or have appropriate authority to authorise the Repair.
29. ADDITIONAL WORK
We will not normally undertake additional work which materially increases the agreed price without Customer authorisation.
Where rejecting necessary additional work means the Repair cannot reasonably be completed to an appropriate standard, we may stop the Repair.
30. COMPLETION & CUSTOMER INSPECTION
Where reasonably possible, the Customer should inspect the Repair upon completion.
Any immediate concerns should be raised so that they can be assessed.
Payment, electronic sign-off or acceptance of the Vehicle does not remove statutory rights relating to defects subsequently discovered.
31. COLLECTION OF VEHICLES
Where a Vehicle has been repaired at 21 Shorcroft Avenue, the Customer must collect it promptly after being informed that the Vehicle is ready for collection.
The Customer should arrange collection within the time agreed or otherwise communicated by us.
Where the Customer cannot collect within that period, they should contact us as soon as reasonably possible to discuss alternative arrangements.
32. STORAGE CHARGES
Where a Customer fails to collect their Vehicle within the agreed or reasonable collection period after being informed that it is ready for collection, a storage charge of:
£45 PER DAY OR PART THEREOF
may become payable.
Where reasonably practicable, the Customer will be informed before storage charges begin to accrue.
The storage charge reflects the continuing occupation of limited Vehicle storage space and associated inconvenience and administration and is not intended to operate as a penalty.
Where additional administration is reasonably required because a Vehicle remains uncollected, we may also seek reasonable and proportionate administration costs actually incurred, where lawful and where those costs have been appropriately communicated.
Storage and administration charges will only be sought to the extent they may reasonably and lawfully be recovered.
33. UNCOLLECTED VEHICLES
Where a Vehicle remains uncollected for an extended period, we will make reasonable efforts to contact the Customer or other person entitled to collect it.
This may include:
- Telephone;
- SMS;
- WhatsApp;
- Email; and
- Written notice to the last known address.
Customers must keep their contact information reasonably up to date while their Vehicle remains with us.
Where the Customer cannot be contacted, refuses to collect the Vehicle or continues to leave it with us despite reasonable requests for collection, DJ Auto Body Repair may exercise rights available under applicable law concerning uncollected goods.
34. SALE OF AN UNCOLLECTED VEHICLE
An uncollected Vehicle does not automatically become the property of DJ Auto Body Repair.
Where legally permitted, we may ultimately exercise a power of sale under the Torts (Interference with Goods) Act 1977 or other applicable law.
Any sale will only take place after the applicable legal requirements have been followed.
This may include:
- Giving notice requiring collection of the Vehicle;
- Giving any required notice of intention to sell;
- Allowing the legally required period to expire;
- Taking reasonable steps to contact the person entitled to the Vehicle; and
- Complying with other applicable procedural requirements.
Where the relevant statutory procedure permits a sale, DJ Auto Body Repair may sell the Vehicle using a reasonable method having regard to the circumstances.
Where permitted by law, sums which may lawfully be deducted from the proceeds may include:
- Outstanding Repair charges;
- Lawful storage charges;
- Amounts lawfully owed before the relevant statutory notice;
- Reasonable costs of arranging the sale; and
- Other sums which may lawfully be recovered.
Any remaining balance of the sale proceeds will be accounted for to the person legally entitled to it in accordance with applicable law.
Nothing within these Terms gives DJ Auto Body Repair a broader right to sell, dispose of or acquire ownership of a Vehicle than the law provides.
35. PAYMENT
Unless otherwise agreed in writing, payment is due in full upon completion of the Repair.
Any Booking Fee forming part of the Repair price will be deducted from the final balance.
Where applicable, lawful storage or other properly due charges may also become payable.
Where third-party finance or instalments have been agreed, separate terms may apply.
36. OVERDUE CONSUMER PAYMENTS
Where an amount owed by a Consumer remains unpaid after becoming due, we may issue reasonable payment reminders and request settlement.
Any interest, recovery charge or additional amount sought from a Consumer will only be claimed where legally recoverable, fair and proportionate.
We will not impose an arbitrary percentage penalty merely because payment is late.
A Customer who genuinely disputes an invoice should notify us promptly so that the matter can be investigated.
37. BUSINESS & TRADE CUSTOMER LATE PAYMENTS
Where a qualifying commercial debt owed by a Business Customer is paid late, DJ Auto Body Repair reserves its rights under the Late Payment of Commercial Debts (Interest) Act 1998 and applicable legislation.
This may include:
- Statutory interest;
- Statutory fixed recovery compensation; and
- Additional reasonable recovery costs where legally recoverable.
Any entitlement will be calculated in accordance with the law applying when the payment becomes overdue.
38. DEBT RECOVERY
Where an amount remains unpaid after becoming due, we may take reasonable and lawful recovery action.
This may include referral to:
- A debt collection agency;
- A solicitor;
- Another appropriate recovery provider; or
- Court proceedings.
Where legally permitted, we may seek recoverable interest, court fees and reasonable recovery costs.
We will not impose arbitrary or disproportionate collection charges on Consumers.
Referral for recovery does not prevent a Customer from raising a genuine dispute.
39. THIRD-PARTY FINANCE
Where a Customer chooses a third-party finance or instalment provider, that provider's eligibility requirements, privacy arrangements and contractual terms apply.
Approval is not guaranteed.
Unless otherwise agreed, failure to obtain finance does not retrospectively invalidate work already authorised and completed.
40. INSURANCE CLAIMS
Unless expressly agreed otherwise, the Repair contract is between DJ Auto Body Repair and the Customer authorising the work.
Where the Customer intends to recover the cost from an insurer or another third party, the Customer remains responsible for payment unless we expressly agree otherwise.
We cannot guarantee reimbursement by an insurer or third party.
41. LEASE, PCP, PCH, FINANCE & FLEET VEHICLES
Where a Vehicle is leased, financed, subject to PCP, PCH or Hire Purchase, operated as a fleet Vehicle or subject to another return arrangement, the Customer remains responsible for understanding applicable return requirements.
Unless expressly confirmed otherwise, DJ Auto Body Repair does not act as an approved inspector or representative of a leasing company, finance provider, manufacturer, fleet operator or inspection organisation.
Customers are encouraged to provide relevant fair wear and tear or return standards before authorising the Repair.
42. END-OF-LEASE & THIRD-PARTY INSPECTIONS
A professionally completed aftermarket Repair may still be identifiable by a trained inspector.
We cannot guarantee that:
- A leasing company will accept a Repair;
- An inspector will regard the Vehicle as meeting its criteria;
- No further work will be requested; or
- The Customer will avoid end-of-contract charges.
DJ Auto Body Repair is not responsible for penalties, excess wear-and-tear charges, refurbishment charges or inspection charges merely because a third party applies its own standards or identifies an aftermarket Repair.
A third party requesting further work does not by itself establish that our Repair was defective.
Where a third party alleges a workmanship defect, we should be given a reasonable opportunity to inspect the Vehicle.
Nothing within this section excludes responsibility for loss caused by our failure to carry out the agreed Repair with reasonable care and skill.
43. THREE-YEAR BODYWORK WORKMANSHIP WARRANTY
DJ Auto Body Repair provides a 3-Year Bodywork Workmanship Warranty on qualifying bodywork and paint refinishing carried out by us.
The Warranty starts on the date the qualifying Repair is completed.
The Warranty is an additional contractual benefit and does not replace, reduce or restrict statutory consumer rights.
44. WHAT THE WARRANTY COVERS
Subject to these Terms, the Warranty covers defects demonstrated to result directly from our workmanship or application of Repair materials.
Examples may include:
- Paint peeling caused by our application;
- Delamination attributable to our workmanship;
- Loss of adhesion attributable to our work;
- Premature paint failure attributable to our workmanship;
- Failure of primer, basecoat or clearcoat applied by us; or
- Failure of body filler applied by us.
Where a valid Warranty claim is established, we will normally rectify the qualifying affected area without additional labour or material cost.
45. WARRANTY EXCLUSIONS
The Warranty does not cover damage or deterioration not caused by our workmanship, including:
- Corrosion or rust;
- Stone chips or road debris;
- Subsequent scratches, scuffs or dents;
- Collision or accident damage;
- Parking impacts;
- Vandalism;
- Deliberate damage;
- Environmental contamination;
- Bird lime;
- Tree sap;
- Industrial fallout;
- Inappropriate chemicals;
- Abrasive cleaning;
- Inappropriate pressure washing;
- Failure to follow reasonable aftercare instructions;
- Subsequent alteration or Repair by another Repairer;
- Failure of an underlying previous Repair;
- Failure of pre-existing filler or coatings;
- Defects in an underlying substrate not caused by our Repair;
- Normal wear and tear; and
- Mechanical, electrical, drivetrain, battery, charging, electronic or high-voltage system faults not caused by our workmanship or actions.
46. WARRANTY & PREVIOUS REPAIRS
Where another party previously painted, filled or repaired the affected area, our Warranty applies only to work and materials applied by DJ Auto Body Repair.
We cannot warrant the integrity of underlying materials applied by another party.
47. WARRANTY & CORROSION
DJ Auto Body Repair does not undertake corrosion Repairs.
No Warranty is given against corrosion or rust.
This includes existing or concealed corrosion, corrosion beneath previous filler, corrosion behind panels, corrosion around seams or corrosion subsequently spreading into the repaired area.
48. WARRANTY & COLOUR AGEING
We exercise reasonable care and skill when colour matching at the time of Repair.
The Warranty does not guarantee that original factory paint and newly refinished paint will age, fade or weather at precisely the same rate.
49. BODYWORK-ONLY WARRANTY
The 3-Year Warranty applies only to qualifying bodywork and paint refinishing carried out by DJ Auto Body Repair.
Unless expressly confirmed otherwise, it does not cover:
- Alloy wheel refurbishment;
- Tyres;
- Glass;
- Mechanical components;
- Electrical systems;
- Batteries;
- Charging systems;
- High-voltage systems;
- Parking sensors;
- Cameras;
- Radar;
- ADAS systems;
- Calibration;
- Unrelated trim; or
- Unrelated Vehicle components.
50. MAKING A WARRANTY CLAIM
Customers should contact us as soon as reasonably practicable after identifying a potential workmanship defect.
We may request:
- Photographs;
- Videos;
- Repair references;
- Invoice information;
- Vehicle registration;
- Information concerning subsequent damage or Repairs; and
- Reasonable access to inspect the Vehicle.
DJ Auto Body Repair should be given a reasonable opportunity to inspect the alleged defect.
Where reasonably practicable, another Repairer should not alter the disputed area before we have had an opportunity to inspect it.
Intervention by another Repairer does not automatically remove statutory rights but may affect an additional Warranty claim where it prevents the original cause from being reasonably established.
51. WARRANTY REMEDY
Where a defect is covered by our Warranty, the normal remedy will be to repeat or rectify the affected Repair without additional labour or material charge.
Where another remedy is required by applicable consumer law, statutory remedies remain available.
52. AFTERCARE
Customers must follow reasonable aftercare instructions supplied following the Repair.
Freshly refinished areas may require time before:
- Washing;
- Machine polishing;
- Waxing;
- Pressure washing;
- Applying adhesives;
- Applying ceramic coatings;
- Applying protective films; or
- Using strong chemicals.
Damage caused by failure to follow reasonable aftercare instructions is not covered by the additional Warranty.
53. PERSONAL PROPERTY
Customers should remove valuables, cash and fragile or irreplaceable belongings from Vehicles before Repair or storage.
Nothing within this section excludes responsibility for loss or damage caused by us where liability cannot lawfully be excluded.
54. PHOTOGRAPHS & REPAIR RECORDS
We may photograph or video the Vehicle before, during and after a Repair for legitimate business purposes, including:
- Recording condition;
- Damage assessment;
- Documenting pre-existing defects;
- Quality control;
- Documenting completed work;
- Warranty administration;
- Complaints handling; and
- Maintaining Repair records.
Further information is provided in our Privacy Policy.
55. MARKETING PHOTOGRAPHS
Repair photographs may be used for advertising, our website, portfolio or social media in accordance with applicable privacy and data-protection requirements.
Where specific consent is required, appropriate permission will be obtained.
Vehicle registrations or other identifying information may be obscured where appropriate.
56. ELECTRONIC COMMUNICATIONS
We may communicate with Customers through:
- SMS;
- WhatsApp;
- Email;
- Telephone; and
- Online quotation or Booking systems.
Electronic communications may be used for Quotations, photographs, appointments, reminders, authorisations, additional-work approval, cancellations, payments, invoices, Warranty matters and complaints.
57. DISAPPEARING MESSAGES
DJ Auto Body Repair does not ordinarily enable disappearing messages for Customer communications.
Customers may independently enable automatic-deletion features within their own messaging applications.
We may separately retain relevant business records, including Quotations, instructions, approvals, cancellations, payment communications, complaints and Warranty communications, where reasonably necessary and lawful.
Use of disappearing messages does not automatically invalidate a communication already validly made.
58. DATA PROTECTION
Personal information may be processed for purposes connected with:
- Enquiries;
- Quotations;
- Bookings;
- Customer Photographs;
- Repairs;
- Communications;
- Invoicing;
- Payments;
- Warranty administration;
- Complaints;
- Debt recovery; and
- Legitimate business administration.
Further information is provided in the DJ Auto Body Repair Privacy Policy.
59. COMPLAINTS & OPPORTUNITY TO RECTIFY
Customers dissatisfied with a Repair should contact us as soon as reasonably possible.
We may request photographs and arrange an inspection.
Where a workmanship concern is raised, DJ Auto Body Repair should ordinarily be given a reasonable opportunity to inspect the Vehicle.
Where an issue is attributable to our work and repeat performance is an appropriate remedy, we should ordinarily be given a reasonable opportunity to rectify it.
Nothing within this section restricts statutory rights.
60. EVENTS OUTSIDE OUR REASONABLE CONTROL
We may need to delay or rearrange work because of circumstances outside our reasonable control, including:
- Severe weather;
- Illness;
- Road closures;
- Serious traffic disruption;
- Accidents;
- Vehicle breakdown;
- Equipment failure;
- Power interruption;
